Stairway from Sidewalk to Basement Didn’t Require Handrails

Commercial tenant’s employee sued landlord and its storefront commercial tenant for damages after he slipped and fell on a stairway leading from sidewalk doors into the building basement. A conveyor belt to the basement used to transport deliveries had been installed on top of the stairway by commercial delicatessen tenant 30 years ago. Among other things, the employee claimed that landlord was responsible for his injuries because the sidewalk stairway lacked handrails.

Exterior Work Includes Parapet Replacement

The DRA granted landlord’s application for MCI rent hikes based on exterior restoration. Tenants appealed. Among other things, they claimed that the work was defective and incomplete and that there was water infiltration in some apartments from the exterior walls. The DHCR ruled against tenants. The DRA had fully considered their evidence, including an engineer’s report. DHCR inspection found that all sides of the building had been pointed and that the MCI was done in a workmanlike manner.

Tenants Get Permanent Exemption from MCI Rent Hikes

Tenant exempt from MCI increase due to water damage.
Landlord applied for MCI rent hikes based on pointing/brick work. The DRA ruled for landlord, but exempted one apartment from the rent increase.

Landlord appealed and claimed that it was unfair to give tenant a permanent exemption from the MCI rent hike eight years after the work was completed. Pointing and brick work were performed where needed, and the leak or moisture found in tenant’s apartment weren’t directly related to the MCI.

The DHCR ruled against landlord. To qualify for an MCI rent hike, after work is completed the building facade must be free from water seepage for 15 years. The fact that tenant had water damage eight years after the MCI was completed showed that the work was insufficient in the area of tenant’s apartment.
